Since the beginning of 2020, the Trade Union Legal Advisory Center (Provincial Labor Federation) has provided legal advice to nearly 5,000 workers and employees and directly provided legal support to 368 cases. Thereby, helping many employees claim their benefits when they are fired, payment of salaries and bonuses, overtime regime and other policies that are not in accordance with the law.

Protecting legitimate rights and interests of Employees

 

Recently, a number of employees who had been unilaterally terminated by an unilateral company - having come to the provincial Trade Union Legal Advisory Center for assistance in lawsuits - were compensated by said company for violating the compensation of VND 60 -70 million/person.

 

Thanks to the help from the provincial Trade Union Legal Advisory Center to support the lawsuit, Mr. Huynh Le Dung (living in Ho Chi Minh City) has been compensated nearly VND 247 million by a company (severance pay, wages during non-working days, 2-month compensation, pay unemployment insurance) for unlawful firing of employee. Mr. Dung expressed that if he was not supported by the lawyers and officials of the Provincial Trade Union Legal Advisory Center in a timely and enthusiastic manner, he could not fight for himself in such a full and legal manner.

 

Lawyer Vu Ngoc Ha, Director of the provincial Trade Union Legal Advisory Center shared that working with the employees in the struggle for their legitimate and legitimate rights is the duty and responsibility of the Center. Through that, it aims to propagate and disseminate labor laws to employers and employees to help them grasp and implement seriously.

 

Understand ing the Employees

 

Lawyer Vu Ngoc Ha said that disputes arising in the labor relationship between employers and employees are diverse. Through legal advice and assistance, employees will understand and fully grasp the labor law to protect their legitimate rights and interests when being abused.

 

“Not all employees have full and accurate knowledge about the law to give themselves reasonable solutions. Therefore, they need a center for legal advice and assistance when disputes arise with their employers. Therefore, the center is willing to listen and support employees all the issues that they ask, regardless of conflicts, big or small disputes, whether the employees are in more or less disadvantaged, etc. The problem is to help employees understand and grasp the law so that they can avoid in future and have solutions to handle which in accordance with the law, the right context and situation”- lawyer Ha said.

 

Also according to lawyer Vu Ngoc Ha, in order to effectively propagandize, popularize and educate laws for employees, they should diversify forms of propaganda; Propaganda content must be specific, concise but ensure the adequacy and basic issues that employees need to find out. In addition, the Trade Union officials must regularly listen to the opinions and recommendations of grassroots and employees and supervise the implementation of legal policies in enterprises to ensure the legitimate legal rights of employees.

 

Lawyer Le Tan Ty, provincial Trade Union Legal Advisory Center, said that through lawsuits to claim benefits, employees will fully, specifically and accurately understand the labor law when their legitimate and legitimate rights and interests are violated by employers. However, this is not the optimal solution, the most important thing is the dissemination and propaganda of laws to businesses, employers and employees so that they understand and properly implement and limit the conflicts lead to disputes and complaints in court that often take time and effort.
