Business and Law Forum 2024

​(News Portal – Dong Nai) – On October 9, the Central Council for Coordinating Legal Dissemination and Education organized the Business and Law Forum 2024 for Collaborating to Resolve Legal Difficulties and Obstacles, Contributing to Creating a Favorable Investment Environment for Businesses. The forum was held both in-person and online with 63 connection points from provinces and municipalities. 

At the Dong Nai connection point, the forum was chaired by Vice Chairman of the Provincial People's Committee, Mr. Nguyen Son Hung, and Deputy Director of the Department of Justice, Vice Chairwoman of the Provincial Council for Coordinating Legal Dissemination and Education, Mrs. Nguyen Thi Kim Huong.  

At the Central connection point, attendees included Deputy Prime Minister, Chairman of the Central Council for Coordinating Legal Dissemination and Education, Mr. Le Thanh Long; Minister of Justice, Permanent Vice Chairman of the Central Council for Coordinating Legal Dissemination and Education, Mr. Nguyen Hai Ninh.

The discussions at the forum centered around two main issues. The first one involved addressing several legal matters concerning land-use investment projects. Specifically, identifying existing inconsistencies resulting from conflicts and incompatibilities between legal documents in construction investment activities, as well as obstacles in regulations and implementation. Additionally, the forum discussed the prolonged timelines for preparing investment projects and navigating approval procedures, which have delayed investments and created difficulties for businesses.

The second issue focused on legal obstacles related to taxation and solutions to resolve them. This included discussions on challenges related to VAT refunds, the process and procedures for ensuring transparency in VAT refund policies, and ensuring that VAT refunds are conducted promptly based on risk management principles, in accordance with the legal tax management framework. Corporate income tax regulations also require revisions, especially given the trend of multi-sector, multi-field operations by businesses. Moreover, in the context of administrative reform efforts aimed at facilitating businesses, the current regulation requiring companies to file and pay separate taxes on profits from real estate transfers is proving to be restrictive and in need of adjustment.

In his directive speech at the forum, Deputy Prime Minister Le Thanh Long requested that the Ministry of Justice—acting as the permanent body of the Central Council for Coordinating Legal Dissemination and Education—compile all the contributions made during the forum and provide a written report to the Prime Minister for further guidance. He also called on relevant ministries, sectors, localities, and units to continue their support of the business community, working together to “resolve legal challenges to the very end" that businesses face, thereby contributing to the creation of a transparent and genuinely favorable environment for investment, production, and business operations.
