Many issues related to the project were raised at the workshop for exchange and discussion, including: actual local needs; the process of implementing legal support for enterprises; trouble, difficulty; suggestions, recommendations and other related issues. Thereby helping the Ministry of Justice obtain important information to supplement and complete the project before submitting it to the Prime Minister, expected at the end of 2022.

The importance of the project

Mr. Tran Minh Son, Head of the Inter-sectoral Legal Assistance Program Office for Small and Medium Enterprises (Ministry of Justice), said that legal support work for enterprises, especially small and medium-sized enterprises, has received deep attention from the Party and Government in recent years. The legal basis for legal support activities has also been continuously consolidated and developed from the Government's Decree No. 66/2008/ND-CP dated May 28, 2008, the Law on Supporting Small and Medium Enterprises in 2017 to the Decree No. 55/2019/ND-CP dated June 24, 2019 of the Government and relevant legal documents. In parallel with the completion of the legal framework for legal support work for enterprises, legal support programs have also been developed and implemented.

Up to now, legal support activities for enterprises in general and small and medium-sized enterprises in particular have achieved many positive results, which are recorded in the document of the 13th National Congress of the Party: "Legal support for enterprises has taken a strong step forward". At the same time, the document also identified the focus and orientation of business support in general, including legal support for enterprises in the period of 2021-2030, including: enhancing the legal access of enterprises; supporting enterprises with legal issues in settling commercial disputes, minimizing risks in international integration; have policies to support the effective operation of enterprises; activities to support businesses in the direction of unity, focus, national level and show inter-sectoral and inter-regional character.

In response to the requirements of the Document, the Government has issued 4 resolutions to assign the Ministry of Justice to develop the project "Improving the quality and efficiency of legal support for enterprises in the 2021-2030 period". The objective of the project is to complete the legal framework on legal support for enterprises, aiming at 100% of enterprises to get free legal aid when they need it; settle and remove legal difficulties for state-owned enterprises, small and medium-sized enterprises when there is a need; effectively operate the network of legal consultants, complete the database of cases and legal problems for enterprises...

​Towards enterprise's benefits

At the seminar, many representatives of departments, branches, and the Bar Association participated in speeches about the practice of legal support for enterprises in the province and solutions to improve the efficiency of legal support for enterprises. associated with the project: "Improve the quality and efficiency of legal support for businesses in the period of 2021-2030".

A representative of the Department of Planning and Investment said that the Department has advised the Provincial People's Committee to direct the synchronous and effective implementation of policies to support small and medium-sized enterprises in accordance with the law and the Government's direction, in order to accelerate the speed of business development. develop and enhance the competitiveness of enterprises in the locality. Every year, the Department also advises the Provincial People's Committee to organize many conferences to meet businesses to grasp the difficulties and obstacles to solve for businesses, creating conditions for businesses to develop steadily.

According to a representative of the Department of Industry and Trade, every year, the Department builds a plan on propagating and disseminating the law to businesses in the province, in order to strengthen support for businesses to promptly grasp the provisions of the law; timely information on new regulations and policies of the State related to production and business activities in many forms. The propaganda of legal systems for enterprises related to the management field of the Department has met the needs of enterprises to access information, minimized issues related to legal disputes or undesirable violations of regulations of enterprises.

Mr. Phan Quang Tuan, Deputy Director of the Department of Justice, said that with the planning of 39 industrial zones and nearly 19,000 hectares, Dong Nai is currently a province with a strong industry in the Southeast region, as well as the whole country. Currently, the province has over 38,000 enterprises, of which small and medium enterprises account for over 86%. Since then, the needs of enterprises in accessing the provisions of relevant laws and policies is very huge.

Over the past time, the Department of Justice has also actively implemented legal aid work for small and medium-sized enterprises in the province, such as issuing documents to implement the scheme; building and exploiting the provincial legal database; consulting, answering legal problems… “Enterprises have had quick access to legal information; regimes, policies and laws are introduced and trained in a timely manner to enterprises, contributing to improving legal qualifications for enterprises; promptly solve administrative procedures, difficulties and problems, contributing to improving the business investment environment for enterprises, limiting risks and disputes in business of enterprises "- Mr. Tuan shared.

However, besides the achieved results, legal support for enterprises in the province still has some difficulties and problems. Specifically, a number of legal provisions have not yet specified the contents or overlapped among legal documents; some businesses are still not interested in local support policies, the sense of compliance and compliance with the law is not high; staffs of enterprises are still limited in understanding, researching and applying the law; Civil servants working in legal aid for enterprises in agencies, units and localities are all part-time, and have not been regularly trained in legal knowledge and legal support skills for enterprises.

At the seminar, the delegates also gave many suggestions to improve and raise the quality and efficiency of legal support work for enterprises associated with the project. In which, it is necessary to issue specific regulations on legal support programs for enterprises for each ministry and sector; continue to improve the quality and effectiveness of law propagation and dissemination; strengthen the exchange and sharing in order to promptly support the provision of legal information to enterprises. At the same time, it also regularly opens training courses, fostering professional skills for the provincial legal consultancy network, staff working in legal assistance for enterprises...

Speaking at the conclusion of the seminar, Mr. Nguyen Thanh Tu, Director of the Agency of Civil and Economic Law, Deputy Head of the Management Board of the Inter-sectoral Legal Cooperation Program for Small and Medium Enterprises (Ministry of Justice) highly appreciated the quality of the conference. In the draft, the comments and suggestions for the draft project are focused and practical. The delegation will receive and record the opinions of the delegates and will supplement and complete the draft project before submitting it to the Prime Minister.
