Proactively Preventing and Combating Violations in the Tax Sector

(News Portal – Dong Nai) - As a key locality in economic development, Dong Nai has tens of thousands of enterprises operating. Recently, along with the nationwide situation, several cases of tax law violations by businesses have occurred in the province, particularly focusing on tax invoice fraud, which complicates management and economic development.

Steel is one of the items that need to be tightly controlled to prevent tax fraud. 

With the advancement of technology, the modernization and reform of administrative procedures by the State have created a more favorable business environment; however, new methods of tax-related criminal activity have also emerged, necessitating closer cooperation between the tax authorities and the provincial police in this new phase.

Significant Results in Collaborative Efforts

According to evaluations from the Dong Nai Tax Department and the provincial police, through cooperation, many tax law violations have been prevented and strictly dealt with to combat revenue loss for the State budget, creating a healthy and equitable business environment, thereby contributing to maintaining public order and promoting socio-economic development in the province.

Mr. Tram Thien An, Head of Inspection Department 5 at the Dong Nai Tax Department, reported that from 2020 to June 2024, through collaboration, the two agencies identified over 8,800 businesses that no longer operated at their registered addresses (abandoned business locations); they also uncovered 45 cases of illegal value-added invoice use. The tax authority provided information upon request for 237 cases, and conducted forensic examinations for 59 cases...

Through cooperation with the Dong Nai Tax Department, the provincial police have prosecuted 24 cases and 42 defendants for tax violations, including 18 cases of tax evasion and 6 cases of invoice trading. The total damage to the State budget is estimated to be over 31 billion VND, with over 20 billion VND successfully reclaimed.

Coordination Among Authorities Needed
Although cooperation between the tax sector and police has been implemented for many years, certain difficulties still persist. Many violations related to the illegal purchase and use of invoices to evade taxes are becoming increasingly sophisticated, complicating tax management and police investigations. In some cases, offenders issue invoices using fictitious identities, making verification challenging and often lacking sufficient evidence to determine the violation, posing a challenge for the collaboration between the two agencies.

To further strengthen the prevention and combat of tax-related crime, the Dong Nai Tax Department and the provincial police recently signed a coordination regulation. The goal is to enhance the responsibilities of relevant units under the two sectors while ensuring concentration and unity in directing and managing the prevention of violations and crimes in the tax sector.

The proposed solutions involve the provincial police and the Dong Nai Tax Department continuing to exchange information on methods and tricks of tax evasion and fraud to prevent and combat tax crimes. Additionally, there will be an increase in guidance and encouragement for local tax authorities and police. Proactive coordination will be implemented to effectively recover tax debts from stubborn businesses that have prolonged tax arrears or deliberately failed to comply with tax payments.​

Colonel Le Manh Hung, Deputy Director of the provincial police, stated that to achieve high effectiveness, one of the solutions is to closely coordinate in information exchange, especially regarding new methods and tricks of crime. This will provide a solid basis for addressing emerging issues and coordinating the verification of records and information showing signs of violations to prevent, investigate, and handle them. Furthermore, attention should be focused on certain prominent cases that are developing complexly at specific times, such as newly established enterprises exploiting illegal invoice trading in specific sectors: steel, fuel, e-commerce... ​
